1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your use of the carrentalbaku.com website and all car rental services offered through it in Baku City, Azerbaijan. By accessing this site, submitting a booking inquiry, or completing a vehicle reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.

These Terms constitute a legally binding agreement between you ("the Customer") and carrentalbaku.com ("the Company", "we", "us", or "our"). If you do not agree to these Terms, you must not use our website or services. We reserve the right to update these Terms at any time. Continued use of the site after changes are published constitutes acceptance of the revised Terms.

Our services are provided in accordance with the laws and regulations of the Republic of Azerbaijan. Local traffic laws, including those applicable to driving in Baku City, along the Absheron Peninsula, the Baku-Shamakhi highway, and roads leading to Gobustan and other regions, apply at all times during your rental period.

2. Eligibility and Licensing Requirements

To rent a vehicle through carrentalbaku.com, the primary driver must meet all of the following eligibility requirements at the time of pickup:

• Be at least 21 years of age for standard vehicle categories (economy, compact, standard).
• Be at least 25 years of age for premium, luxury, and large SUV categories. Young driver fees may apply for drivers aged 21-24 on eligible vehicle classes.
• Hold a valid national driver's license that has been held for a minimum of 2 years continuously.
• Present an International Driving Permit (IDP) alongside their national license when required under Azerbaijani traffic regulations. Drivers from most EU, UK, US, and Gulf Cooperation Council countries are generally accepted with their national license; however, an IDP is strongly recommended for all international visitors.
• Present a valid passport or national identity document at the time of vehicle pickup.
• Present the payment card or bank account details used during booking.

Additional drivers must meet the same licensing and age requirements and must be registered at the time of booking or no later than vehicle pickup. An additional driver fee may apply. Any driver found operating the vehicle without being registered on the rental agreement will void the insurance coverage and render the primary driver fully liable for any damage or incidents.

We reserve the right to refuse a rental if the primary driver or any registered additional driver fails to produce valid documentation at pickup, regardless of whether payment has been made.

3. Bookings and Cancellation Policy

Reservation Process

All bookings are made through the carrentalbaku.com booking widget or affiliated partner platforms. A confirmed booking requires submission of your rental dates, pickup and return locations within Baku City, Azerbaijan (including Heydar Aliyev International Airport, city center locations, and hotel delivery zones), vehicle category selection, and valid payment details. A booking confirmation email is sent upon successful reservation.

We offer a no deposit, no credit card hold booking process. Debit cards and most major payment methods are accepted. No funds are frozen or blocked on your card at the time of booking under our standard terms.

Free Cancellation

Customers may cancel their reservation free of charge up to 48 hours before the scheduled pickup time. Cancellations made within 48 hours of pickup may be subject to a cancellation fee equivalent to one day's rental at the booked rate. No-show fees (where the customer does not collect the vehicle and does not cancel) may equal up to the full value of the first rental day.

To cancel, contact us via email at [email protected] with your booking reference number. Cancellations are processed within 3-5 business days. Refunds, where applicable, are returned to the original payment method.

Modifications

Booking modifications including date changes, vehicle upgrades, and extra equipment additions are subject to availability and may be accommodated up to 24 hours before pickup. We cannot guarantee modifications requested with less than 24 hours' notice.

4. Pricing, Payment, and Optional Extras

Displayed Currency and Inclusions

All prices displayed on carrentalbaku.com are shown in US Dollars (USD) unless otherwise stated. Quoted rental rates include the base vehicle hire, standard third-party liability insurance, and unlimited mileage where advertised. Prices are inclusive of local taxes applicable under Azerbaijani law.

Optional Extras

The following optional extras may be added at the time of booking or at vehicle pickup, subject to availability:

• Child seat (infant, toddler, or booster) - available for families traveling with young children in Baku City, Azerbaijan.
• GPS navigator - recommended for driving beyond Baku City, particularly on routes to Sheki, Gabala, Quba, and Lankaran.
• Wi-Fi hotspot - mobile data device for in-vehicle connectivity.
• Additional driver registration - per additional driver, per rental day.
• Full coverage upgrade - reduces or eliminates the collision damage waiver excess (see Section 7).
• Winter tires - required by law on certain mountain routes from November through March.

Fuel Policy

Vehicles are provided with a full fuel tank and must be returned with a full tank. If the vehicle is returned with less fuel than at pickup, a refueling charge plus a service fee will be applied. The applicable fuel price is based on current commercial rates in Baku at the time of return. Customers are encouraged to refuel at petrol stations along the Baku ring road or in the Narimanov and Binagadi districts before returning the vehicle.

5. Vehicle Use Rules and Prohibited Activities

Vehicles rented through carrentalbaku.com must be used only for lawful purposes and in accordance with all applicable traffic laws of the Republic of Azerbaijan. By accepting these Terms, you agree to the following conditions of use:

• The vehicle must be operated only by the primary driver or registered additional drivers named on the rental agreement.
• Subletting, re-renting, or transferring the vehicle to any third party is strictly prohibited.
• Off-road driving, including use on unpaved mountain tracks in the Caucasus foothills, dry riverbeds, or beach terrain near the Absheron coastline, is not permitted unless the rental specifically authorizes off-road use in writing.
• The vehicle must not be used for motor racing, track driving, timed trials, or any form of competitive driving.
• Driving under the influence of alcohol, narcotics, prescription drugs that impair driving ability, or any other intoxicating substance is strictly prohibited and will void all insurance coverage.
• The vehicle must not be used to transport hazardous materials, illegal goods, or more passengers than the vehicle's designated seating capacity.
• Crossing international borders with the vehicle (e.g., into Georgia or Iran) is not permitted without prior written authorization from the Company.
• Smoking is not permitted inside any rental vehicle. A cleaning surcharge will be applied if evidence of smoking is found upon return.
• Animals may only be transported in a secured carrier in the luggage area. A cleaning fee will apply if the vehicle interior requires additional cleaning due to pet hair or soiling.

Violation of any of these conditions may result in immediate termination of the rental agreement without refund, full liability for all damages, and reporting to relevant Azerbaijani authorities where required by law.

6. Insurance and Liability

Standard Coverage Included

All vehicle rentals include basic Collision Damage Waiver (CDW) and third-party liability insurance as required under Azerbaijani law. Third-party liability coverage meets the minimum statutory requirements for operating a motor vehicle in the Republic of Azerbaijan.

Excess Amount

Under the standard CDW, the customer remains responsible for an excess (deductible) amount in the event of damage to or theft of the rental vehicle. The applicable excess amount is displayed on your booking confirmation and varies by vehicle category. Standard excess amounts typically range from USD 300 for economy vehicles to USD 1,200 for premium and luxury categories.

Full Coverage Upgrade

Customers may purchase a Full Coverage upgrade at the time of booking or at vehicle pickup. This upgrade reduces the excess to zero for most damage and theft scenarios. Full Coverage does not cover damage resulting from prohibited use as described in Section 5, damage to tires and wheels from negligent driving, or damage caused while driving under the influence.

Customer Liability

The customer accepts full liability for any fines, penalties, toll charges, traffic violations, or parking infringements incurred during the rental period, including charges issued by Baku City traffic enforcement authorities or electronic surveillance systems on Azerbaijani motorways. An administrative processing fee may be added to any fines passed on to the customer.

7. Limitation of Liability

carrentalbaku.com operates as a car rental service provider and booking platform. To the maximum extent permitted under applicable law, the Company's aggregate liability to any customer for any claim arising from or related to the use of our services shall not exceed the total rental fees paid by that customer for the specific booking giving rise to the claim.

We are not liable for indirect, incidental, consequential, or punitive damages including loss of profits, loss of income, or loss of enjoyment of vacation arising from any service failure, vehicle defect, or third-party action. We make reasonable efforts to ensure vehicle availability but cannot guarantee specific makes, models, or colors within a booked category.

The Company is not liable for loss of personal belongings left inside the vehicle during or after the rental period. Customers are advised to remove all valuables from the vehicle whenever it is left unattended, particularly in high-footfall areas such as Icheri Sheher (Old City), Fountains Square, and the Baku Boulevard promenade.

8. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Azerbaijan. Any disputes arising from these Terms or from the provision of car rental services by carrentalbaku.com shall be subject to the exclusive jurisdiction of the competent courts of Baku City, Azerbaijan.

Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve any dispute through direct communication. Customers are encouraged to contact us first at [email protected] with a description of the issue. We aim to respond to all formal complaints within 5 business days.

Nothing in these Terms limits any rights you may have under the applicable consumer protection legislation of the Republic of Azerbaijan or your country of residence where such rights cannot be waived by contract.
